Master of Law [L.L.M.] in Intellectual Property and Trade Law

Course Structure:

The course is of one year and is divided into two semesters. The course is structured in such a way that the students are able to get an in depth knowledge of the specialization of Intellectual Property and Trade laws.

The course is a combination of classroom teaching, seminar and a research based dissertation which every student is compulsorily required to fulfill in order to be able to graduate with the LLM Degree.

Research Methods and Legal Writing

Basics of Legal Research, Research Problems, Hypothesis, Research Design and Sampling, Research Methods and Tools, Tabulation, Analysis, Interpretation and Reporting, Legal Writing.

Acquainting the student with the methods of social science research, using the primary and secondary data in the socio-legal research and using it for practical purposes.

Comparative Public Law

Public Law and its Role in Governance, Basic Principles of Organisation of Govt, and Forms of Govt., Nature and Role of Fundamental Rights in Public Law, Organisation of the Legislature and the Executive, Judiciary and Judicial Process.

Making students understand the Indian polity through a comparative analysis of government, legislative and the role of judiciary.

International Trade Law

The World Trade Organisation, Transnational Transactions and Resolution, Law and Policy on Trade and Investment- Indian Perspective,

This course covers both the public as well as the private aspects of the international trade law.

Competition Law

Introduction to Competition Law, Anti-Competitive Agreements, Abuse of Dominant Position, Combinations, Competition Commission of India, IPR and Competition Law, Modern Dimensions of Competition Law.

Learning about the evolution, objects and functions of Competition Law.

Laws on E-Commerce

Introduction to E-Commerce, Contracts in Electronic Environment, Electronic Signature, Payment Issues, Consumer Protection, IPR Issues in E-Commerce, Taxation in E-Commerce, Jurisdiction Issues in E-Commerce, E-Commerce and Competition Issues, Cloud Computing and E-Commerce.

Understanding the technology and legal regime of e-commerce.

Law of Copyright

Eligibility and Subject Matter, Acquisition of Copyright, Ownership and Transfer, Infringement and Remedies

Learning the conceptual basis of copyright protection and how different works are protected.

Globalization, Law and Justice

Globalisation Process and its Effects, Globalisation and Legal Theory, Policy Issues, Human Rights in the context of Globalisation, Harmonisation of Law.

Understanding the concept of globalization, appropriate jurisprudence, policy issues and human rights.

Investment Laws

Introduction, Shares, Securities Contracts, Securities and Exchange Board, Depositories Act, Principles of International Investment Law.

Introduction to the investment mechanisim in India and related aspects of regulatory framework for the protection of the investor and stake holders.

Law of Patents and Designs

Eligibility and Subject Matter, Acquisition of Patents and Transfer of Rights, Rights, Infringement and Remedies, Industrial Design.

Clarity about the patentable subject matter, procedural aspects of patent acquisition, interpretation techniques and the concept of infringement.

Law of Trademarks and GI

Eligibility and Subject Matter, Acquisition of Trademarks, Infringement and Remedies, Law relating to Geographical Indications.

Historical foundations to trademark protection, practical aspects of trademark acquisition and an understanding of the laws concerning the GI.

Seminar on Contemporary Issues

Tips on Writing and Presentation Skills, Presentations of Contemporary Legal Issues, Presentations on Case Laws, Legal Awareness Camp.

An innovative approach to a law seminar course to develop presentational skills of the students.

Along with the above mentioned syllabi, the students are also required to submit a dissertation during their second semester to test their analytical skills and develop skills as a researcher. Also, by the end of the second semester, the students are required to participate in the seminar and the practical. On successful completion of these courses and the researching, the student is awarded with a LLM Degree in Intellectual Property and Trade Law.
