Chief Justice Dipankar Datta and Justice G S Kulkarni directed two university students, who had asked the court to stay on the examinations, to approach the Vice-Chancellor for any relief they requested.

Following the order of the Supreme Court that final year students may only be promoted on the basis of examinations, Mumbai University issued a circular announcing the schedule for the third year of final semester examinations.

Virtually, the examinations will be conducted from October 01 – 17, 2020.

University counsel Rui Rodrigues told the bench on Saturday that the examinations would be conducted online in a multi-choice question (MCQ) format.

The petitioners, however, have argued through their counsel, Sharon Patole, that the University hastily announced the timetable for the examination.

Patole informed the bench that the MCQ format was new and that students and teachers should have been trained to get used to it.

The petitioners also stated that the schedule was in breach of the University's own circular from June of this year, which stated that colleges had to announce exam schedules at least one month in advance.

Rodrigues argued, however, that the university had decided to hold online exams in the light of the COVID-19 pandemic and that it had made all arrangements to conduct them smoothly.

The bench then said that it could not pass any orders to hold the exams.

"You can withdraw this petition and approach the VC for relief," he said, suggesting that students focus on preparing well for their exams.
