The government of Delhi challenged the recent admission notification of the National Law University Delhi (NLUD) for eliminating reservations for the Other Backward Classes (OBC) and the Economically Weaker Section (EWS) in the High Court today.
The 30 June admission notification of NLUD had removed vertical reservation for OBC and EWS.
According to reports, the government of Delhi has submitted that the decision to remove 22 percent reservation for OBC and 10 percent reservation for EWS is not only an inaccurate interpretation of the order of the court given on 29 June, but it is also against the statutory obligations of the university.
On 29 June, the Delhi High Court had ordered NLUD to maintain the status of last year. In response, NLUD had rolled back the manner in which seats are allocated. It had also ordered a stay on the 50% reservation policy for Delhi-based applicants.
The government of Delhi also sought to have the High Court clarify if its previous order refers only to 50 percent reservation for Delhi NCR candidates or to the vertical reservation for EWS and OBC categories.
Earlier, the court had given an interim order following a plea by NLUD students and alumni who said that the reservation decision struck at the heart of the “standards of excellence” of the university.
After the Delhi High Court order that repealed the 22 percent reservation for OBC and 10 percent reservation for EWS, NLUD had allowed the candidates to withdraw their application for admission to BA LLB Honours, LLM and PhD courses.
The National Testing Agency will hold the All-India Law Entrance Test for admission to NLUD on 18 August, in the form of a remote-proctored test.
