BRABU to Conduct Final Examination For B.Ed Students: Patna HC Ordered

The High Court of Patna has ordered the Babasaheb Bhimrao Ambedkar Bihar University (BRABU) to conduct the final examination for the distant mode B.Ed course of 2015-2017 batch. 

The order was passed by the HC on December 23, 2020. The chancellor cancelled the B.Ed course’s affiliation over lapses on the part of Babasaheb Bhimrao Ambedkar Bihar University (BRABU) and the final examination was not conducted after that.

The court order would have brought relief to more than 500 untrained teachers who were currently working in government schools and waiting for the final examination for more than 3 years now so that they could become certified trained teachers.

A bench of Justice Mohit Kumar Shah had allowed the writ petition of the candidates who had urged the high court in October 2018 to direct the BRABU to conduct their final semester examination for the B.Ed course which was carried out in open distance education mode. 

After hearing the arguments of all the parties, the order was reserved in March 2019. Counsels Binod Kumar Singh and Vagisha Pragya represented the petitioners in the case and Nikhil Kumar Agarwal represented the University.

The Union HRD Ministry has issued a letter on August 3, 2017, stating that untrained teachers in schools should have minimum profession qualification under the Rights to Education Act, 2009. The letter also stated that such untrained teachers will be dismissed and will not be allowed to continue their service beyond March 2019. Hence those who have taken admission at BRABU in the B.Ed distance education course were afraid of losing their jobs.

The state education department has ordered that untrained teachers should be removed if they did not acquire B.Ed or DELED course certified by March 31, 2019. 

A bench of Justice Anil Kumar Upadhyay had passed an order to prevent the termination of the petitioners stating that they were innocents and they should be made to suffer more because of the lapses of the officials.
