DU & NEET State Quota Admissions to be Based on Schooling, Not Domicile: Delhi HC


New Delhi: In a recently concluded hearing, the Delhi High Court has declared that Delhi students who have cleared their class 12th examination from any NCR school can not avail of the benefits of "Delhi Quota" reservation for admissions to colleges in Delhi.

The High Court has informed that for admission to colleges in Delhi, the state quota will now be applicable based on the geographical location of the school. The benefits will only be offered to those who have cleared the class 12th exam from a recognized school or institution in Delhi. 

During the hearing, Justice Sanjeev Narula mentioned that the language of the relevant provision of Delhi Diploma Level Technical Education Institutions Act, which includes Prohibition of Capitation Fee, Regulation of Admission, and other measures is "clear and unambiguous." 

The statement came in response to a petition filed by a student seeking the benefit of reservation for college admissions in Delhi. The student has recently completed their Higher Secondary education from a recognized examination board from a school located in Gurugram. 

In response to the petition, the court stated that since the petitioner has completed their schooling from a school registered and recognized by the state of Haryana, they are not eligible to avail of the state quota admissions for colleges in Delhi. 

Clarifying the decision, the court added that for state quota admissions, the location of schooling will be considered instead of the domicile of students. The statement came only a few days before the declaration of NEET 2022 Results on the National Testing Agency's official website. 

The petition has raised questions over the criteria for admissions to Delhi University under the state quota. In response, the Delhi HC further clarified that the determining factor for availing benefits of Delhi quota will be the school’s geographic location and not the domicile of the candidate. 

With this, those who completed the qualifying exam from a recognized school in Delhi will be eligible to apply for state quota seats in the NEET Counselling 2022. The judgment is only applicable to Delhi and is expected to be extended to the rest of the states in the country.
