GGSIPU Law Students file PIL against Physical Exams; HC Urges Delhi Govt to Respond


Many law students from Guru Gobind Singh Indraprastha University (GGSIPU) filed a PIL against the physical exams in the Delhi High Court. While HC sought a response from the BCI and Delhi Government. 

The law students filed the Public Interest Litigation (PIL) seeking the postponement of the scheduled physical exams that were to be held on November 2, 2020, in the affiliated colleges under GGSIPU

Owing to the law student's PIL and seeking their stand on the plea by November 12, 2020, A bench of Chief Justice Prateek Jalan and Chief Justice D N Patel issued a notice to the following authorities including, 

  • Ministry of Home Affairs
  • Bar Council of India
  • Delhi Government (AAP) 
  • GGSIPU
  • Vivekananda Institute of Professional Studies (VIPS)
  • Amity University and 
  • Universities Grants Commission (UGC) 

However, the Delhi high court didn't pass any interim orders regarding the postponement of the exams. 

In the petition, the students mentioned that they've already taken up several examinations issued by the colleges under various notifications. However, the physical exams are being conducted again for the same course via the offline mode.

The petition filed by the students against the physical exams of GGSIPU was represented by advocate Bhuvan Gugnani in the Delhi High Court.

A plea filed through advocates Jahnvi Sharma and Paritosh Dhawan said that the changing notification and the short period between the exams have made it difficult for the students to manage everything from online classes to internal exams of the current semester and previous semester followed by the physical examination. 

It was mentioned in the PIL that the notification stating the students to take up the physical exams may cause stress to their mental health and it is also violative of their right to life. 

Also, the clashing of two semesters into one is against the student's right to quality education.

The counsel for the students during the hearing said that on Sunday, November 1, a resolution was given by the Bar Council of India (BCI), which permitted the universities and colleges to conduct the physical exams after getting a No Objection Certificate (NOC) from the state disaster management and state government authorities. 

According to the resolution, the universities/colleges must inform the students about conducting the physical exams or give them an option to take the exams now or post the pandemic situation.

The resolution permits the universities/colleges to conduct online exams if they have the facility to do so.

Following the BCI resolutions, the lawyers told the bench that the GGSIPU hasn't been adhering to the resolutions. 

The students in their plea have also mentioned that the September 30 notification released by GGSIPU stated that the minor tests via the physical mode will be conducted from November 2, 2020, for assessment purposes.
